Surplus Funds Claims Involve Real People

Donovan Law represents former owners, heirs and estates, business entities, lienholders, former spouses, and other potential claimants in uncontested and disputed surplus-funds matters.

The Former Homeowner

If you owned the property at the time of foreclosure, you may be entitled to some or all of the surplus remaining.

Heirs of a Deceased Owner

When a property owner passes away before or during foreclosure, their heirs or estate may have a valid claim to surplus funds.

Business Entities

If an LLC or corporation owned the property, the entity—not its members or officers individually—may be entitled to the surplus. Dissolved or inactive entities may require additional legal steps.

Former Spouses

If you held a legal interest in the property through marriage, you may be entitled to a share of the surplus.

Creditors with Recorded Liens

Judgment creditors, junior mortgage holders, and other lienholders may have claims against the surplus. Enforceability and priority depend on the lien and foreclosure record.
